Vanzator –Diplon SRL.
Client / Cumparator –orice persoana fizica care are varsta peste 18 ani sau persoana juridica care acceseaza Site-ul si efectueaza o Comanda. Clientul poate fi denumit in continuare si “Utilizatorul”.
Produse si Servicii – orice produs sau serviciu listat pe Site, inclusiv produsele si serviciile mentionate in Comanda, care urmeaza a fi furnizate de catre Vanzator Clientului ca urmare a Comenzii plasate de Client.
Comanda – un document electronic prin care Cumparatorul transmite Vanzatorului, prin intermediul Site-ului, intentia sa de a achizitiona Produse si Servicii de pe Site astfel cum sunt individualizate in Comanda.
Cosul meu – sectiune din Cont care permite Clientului sa adauge Produse sau Servicii pe care doreste sa le achizitioneze la momentul adaugarii sau la un moment ulterior; in cazul in care Produsele sau Serviciile nu sunt achizitionate la momentul adaugarii prin efectuarea Comenzii, Clientul va beneficia de serviciul oferit de catre Vanzator de urmarire a Produselor si Serviciilor prin primirea de Comunicari Comerciale din partea acestuia.
Campanie – actiunea de a expune in scop comercial, un numar finit de Produse si/sau Servicii avand un stoc limitat si predefinit, pentru o perioada limitata de timp stabilita de catre Vanzator.
Review – o evaluare scrisa de catre destinatarul sau beneficiarul unui Produs sau Serviciu, evaluare redactata pe baza experientei personale si capacitatii acestuia de a realiza comentarii calitative si de a mentiona daca Produsul sau Serviciul respecta sau nu specificatiile mentionate de catre producatorul sau furnizorul Produsului.
Tranzactie – incasarea sau rambursarea unei sume rezultata din vanzarea unui Produs si/sau Serviciu de catre Vanzator Cumparatorului, in numerar sau online, indiferent de modalitat
Comunicari Comerciale – orice tip de mesaj trimis (cum ar fi: e-mail/SMS/telefonic/mobile push/webpush/etc.) continand informatii generale si tematice, informatii cu privire la produse similare sau complementare cu cele pe care Clientul le-a achizitionat, informatii cu privire la oferte sau promotii, oferte personalizate prin profilarea Clientului, informatii referitoare la Produse si Servicii adaugate in sectiunea “Cont/Cosul meu” sau sectiunea “Cont/Favorite” precum si alte comunicari comerciale cum ar fi cercetari de piata si sondaje de opinie. Specificatii – toate specificatiile si/sau descrierile Produselor si Serviciilor asa cum sunt precizate in descrierea acestora din Site
2.1 Contractul se considera incheiat intre Vanzator si Cumparator in momentul primirii de catre Cumparator de la Vanzator, prin intermediul postei electronice si/sau SMS a notificarii de expediere a Comenzii.
2.2 Proprietatea asupra Produselor va fi transferata la livrare, dupa efectuarea platii din partea Cumparatorului in locatia indicata in Comanda (intelegand prin livrare – semnarea de primire a documentului de transport furnizat de curier sau semnarea de primire pe factura fiscala in cazul livrarilor efectuate de personalul Vanzatorului).
2.3 Prin inregistrarea unei Comenzi pe Site, Cumparatorul este de acord cu forma de comunicare (telefonic, e-mail, etc) prin care Vanzatorul isi deruleaza operatiunile comerciale.
2.4. Pentru motive justificate, Vanzatorul isi rezerva dreptul de a modifica cantitatea Produselor si/sau Serviciilor din Comanda. Daca Vanzatorul modifica cantitatea de Produse si/sau Servicii din Comanda va anunta Cumparatorul la adresa de e-mail sau la numarul de telefon puse la dispozitia Vanzatorului la efectuarea Comenzii si va returna suma achitata pentru Produsele nelivrate.
3.1. Clientul poate efectua Comenzi pe Site, prin adaugarea Produselor si/sau Serviciilor dorite in cosul de cumparaturi. Un Produs si/sau un Serviciu adaugat in Cosul Meu este disponibil pentru achizitie in masura in care exista stoc disponibil pentru aceasta. Adaugarea unui Produs/Serviciu in Cosul Meu neurmata de finalizarea Comenzii nu atrage dupa sine inregistrarea acelei Comenzi si nici rezervarea Produsului/Serviciului. Comercializarea online a Produselor are loc in sistem en-detail (comert cu amanuntul), iar nu en-gros (comert cu ridicata).
3.2. Prin finalizarea unei Comenzi, Cumparatorul confirma ca datele furnizate de acesta, in Comanda si in contextul finalizarii acesteia, sunt corecte, complete si adevarate la data plasarii Comenzii.
3.3. Vanzatorul poate anula Comanda efectuata de catre Cumparator, in urma unei notificari prealabile adresate Cumparatorului prin email, fara nicio obligatie ulterioara a vreunei parti fata de cealalta si fara ca vreo parte sa poata sa pretinda celeilalte daune-interese, daca Clientul refuza sa achite valoarea Comenzii si/sau daca Clientul a furnizat date incomplete, neadevarate sau incorecte care fac imposibila livrarea Comenzii. De asemenea, Vanzatorul isi rezerva dreptul de a anula Comenzile care privesc Produse si/sau Servicii afisate pe Site ca urmare a unor erori tehnice sau care, din cauza unor erori tehnice, prezinta preturi evident eronate/derizorii (preturi care pot fi, in mod rezonabil, apreciate ca eronate/derizorii de catre consumatorul mediu), cu consecinta restituirii intregii sume platite de Cumparator in considerarea comenzilor anulate, daca este cazul, in termen de 14 (paisprezece) zile calendaristice.
3.4. Finalizarea de catre Client a Comenzii implica, acceptarea de catre acesta a obligatiei de a face plata pretului Produselor /Serviciilor si a costurilor de livrare, despre al caror cuantum Clientul este informat inainte de confirmarea Comenzii.
3.5. Clientul poate renunta la Comanda inainte de a primi din partea Vanzatorului confirmarea acesteia, prin notificarea Vanzatorului prin email sau telefonic (apelul telefonic trebuie confirmat obligatoriu prin email).
3.6. In cazul unei comenzi preplatite efectuate de catre Client, acesta poate anula comanda pana la pregatirea comenzii de catre Vanzator, prin intermediul website-ului, accesand optiunea “Anuleaza Comanda”. Restituirea sumei catre Client se va efectua de catre Vanzator in termen de cel mult 14 zile de la primirea solicitatii de anulare. Restituirea sumei se va efectua, in contul din care plata a fost efectuata de catre Client.
3.7. Produsele sunt livrate la adresa indicata de Client in Comanda, prin curier sau prin firme de transport cu care Diplon SRL are parteneriat. In cazul in care produsele sunt livrate la adresa indicata de Client in Comanda, prin firme de curierat (de exemplu Fan Courier, Sameday, KLG Europe), livrarea produselor se va face in sistem door-to-door. Pentru produsele care sunt livrate prin firmele de transport cu care Diplon are parteneriat, livrarea produselor se va face in regim de livrare EXPRES. Serviciile de livrare EXPRES presupun doar transportul marfurilor de la magazin la adresa indicata si nu includ manipularea lor in vecinatatea autovehiculului sau pana la usa clientului. Livrarea produselor prin firme de curierat sau prin firme de transport se stabileste de catre sistemul informatic gestionat de Diplon SRL, in functie de anumite criterii, cum ar fi marfa care obiectul Comenzii plasate de catre dvs.
3.8. Produsele sunt livrate de curier doar pe teritoriul Romaniei, indiferent de sistemul de livrare ales de Client, si doar in limita stocului disponibil.
3.9. Termenul de livrare a Comenzii este de cel mult 30 de zile calendaristice incepand cu ziua urmatoare predarii produselor de catre Vanzator catre curier sau catre firma de transport. Termenul estimat de livrare care apare la momentul plasarii Comenzii de catre dvs. este un termen pur orientativ. Termenul efectiv de livrare poate varia in functie debvolumul comenzilor care sunt in asteptare la momentul plasarii comenzii de catre dvs.
3.10. Vanzatorul isi rezerva dreptul de a modifica modalitatile de livrare a Comenzilor sau de a adauga noi modalitati de livrare.
3.11. Costurile de livrare sunt suportate de catre Diplon SRL. Diplon SRL poate decide ca, costurile de livrare sa fie suportate, integral sau partial, de catre Client, in anumite conditii comerciale stabilite de aceasta, caz in care aceste aspecte vor fi anuntate pe Site.
3.12. Pretul, modalitatea de plata si termenul de plata sunt specificate pe Site si in fiecare Comanda si includ TVA si alte taxe aplicabile. Vanzatorul va emite catre Cumparator o factura pentru Produsele si Serviciile livrate, obligatia Cumparatorului fiind sa furnizeze toate informatiile necesare emiterii facturii conform cu legislatia in vigoare.
3.13. Pentru Comenzile pentru care Clientul opteaza pentru livrare in sistem door-to-door, pretul Produselor este cel afisat pe Site.
3.14. Vanzatorul va transmite Cumparatorului factura aferenta Comenzii care contine Produse si/sau Servicii precum si pentru orice alte plati aferente Comenzii, in coletul in care livreaza Produsele.
3.15. Pentru o corecta comunicare a facturii aferente Comenzii, Cumparatorului ii revin obligatiile de a-si actualiza ori de cate ori este cazul datele din Contul sau si de a accesa informatiile si documentele aferente fiecarei Comenzi, existente in Cont.
3.16. Clientul va avea in Contul sau evidenta facturilor emise de Vanzator, putandu-le salva si arhiva la randul sau in orice moment si in orice modalitate pe care o doreste.
3.17. Prin trimiterea Comenzii, Cumparatorul isi exprima acordul sa primeasca facturile si in format electronic prin adaugarea acestora de catre Vanzator in Contul sau prin intermediul postei electronice, la adresa de e-mail mentionata in Contul sau.
3.18. Plata facturilor se va putea face:
- Online prin card bancar sau numerar catre curier in cazul livrarilor la domiciliu;
In cazul platilor online, atat prin cardul personal cat si prin cardul de business, plata se va efectua in aceleasi conditii de siguranta deplina ca si in cazul tranzactiilor realizate la bancomat sau in magazine prin plata la POS. Cardurile acceptate la plata sunt cele emise sub siglele Mastercard, Maestro, Visa si Visa Electron.
3.19. Cumparatorul are dreptul sa se retraga din Contract, respectiv sa returneze un Produs sau sa renunte la un Serviciu, in termen de 14 zile calendaristice, fara invocarea niciunui motiv si fara a suporta alte costuri decat cele de livrare. Termenul de retractare incepe sa curga, conform OUG nr. 34/2014 in:
– ziua in care consumatorul sau o parte terta, alta decat transportatorul si care este indicata de consumator, intra in posesia fizica a Produselor, in cazul contractelor de vanzare, sau:
(i) in cazul in care consumatorul comanda printr-o singura comanda produse multiple care vor fi livrate separat, ziua in care consumatorul sau o parte terta, alta decat transportatorul si care este indicata de consumator, intra in posesia fizica a ultimului produs;
(ii) in cazul livrarii unui produs care consta din mai multe loturi sau piese, ziua in care consumatorul sau o parte terta, alta decat transportatorul si care este indicata de consumator, intra in posesia fizica a ultimului produs sau a ultimei piese;
(iii) in cazul contractelor pentru livrarea periodica de produse pe o perioada de timp determinata, ziua in care consumatorul sau o parte terta, alta decat transportatorul si care este indicata de consumator, intra in posesia fizica a primului produs.
3.20. In cazul in care Clientul exercita dreptul sau legal de retragere, acesta va completa formularul de retur disponibil online pe Site si va trimite Produsul /Produsele catre Vanzator in termen de cel mult 14 zile de la data de la care acesta a comunicat Vanzatorului decizia de retragere. Clientul poate exercita dreptul sau legal de retragere si transmitand un email (la adresa: (info@diplon.ro) sau comunicand aceasta decizie a sa telefonic, catre Vanzator. Produsul / Produsele vor fi returnate in aceeasi forma / componenta in care au fost primite, impreuna cu toate accesoriile lor si ambalate astfel cum au fost ambalate initial.
3.21. Daca Clientul exercita corespunzator dreptul sau de retragere, si va returna produsul comandat in conditiile necesare, ambalat corespunzator cu toate piesele aferente Vanzatorul va rambursa suma in maxim 14 (paisprezece) zile de la data informarii Vanzatorului de catre Cumparator asupra deciziei sale de retragere din Contract. Suma va fi returnata online, la alegerea Cumparatorului.
3.22. Vanzatorul va putea amana rambursarea sumei pana la primirea Produselor sau pana la primirea unei dovezi conform careia acestea au fost expediate, in cazul in care Vanzatorul nu a preluat Produsele el insusi sau prin curierul sau (se va lua data cea mai recenta).
3.23. Daca Produsul este returnat intr-o stare in care nu mai poate fi vandut sau nu mai poate fi vandut ca si nou (ambalaj deschis, accesorii lipsa, Produsul este deteriorat), Vanzatorul are dreptul de a solicita o suma de bani necesara pentru readucerea Produsului in stadiul initial, dupa caz sau pentru a acoperi diferenta de pret rezultata din vanzarea produsului ca resigilat sau, la solicitarea Clientului, Produsul poate fi reexpediat catre acesta din urma, cheltuielile de livrare fiind suportate de catre Client. Aceasta suma se retine de Vanzator din pretul Produselor care trebuie restituit Clientului si se stabileste in functie de valoarea pieselor ce trebuie inlocuite si a manoperei de reconditionare sau ca diferenta dintre valoarea initiala a produsului nou si valoarea de revanzare a produsului folosit de Client. Contravaloarea sumei care se retine din pretul Produsului va fi comunicata Clientului dupa receptionarea Produselor returnate.
3.24. Vanzatorul poate subcontracta in mod liber serviciul de livrare a Comenzilor oricarui tert, ales de catre Vanzator, fara a fi necesara informarea Cumparatorului. Produsele vor fi livrate exclusiv in Romania.
3.25. Produsul care face obiectul unei Comenzi poate fi returnat prin:
(i) curier in caz de Comanda in sistem door-to-door
(ii) operatorii nostri va vor oferi suport in alegerea modalitatii de returnare si va vor oferi detaliile necesare cu privire la adresa de expediere a produselor, ambalare sau contactarea firmei de curierat.
(iii) costul transportului este suportat exclusiv de catre client
3.26. Vanzatorul are dreptul, in orice moment, sa modifice, sa suspende sau sa inceteze comercializarea online a Produselor si / sau Serviciilor, partial sau in totalitate, temporar sau permanent, cu sau fara notificare prealabila. Comenzile valabil confirmate de catre Vanzator, anterior operatiunilor de modificare, suspendare sau incetare dispuse, vor fi in mod corespunzator executate de Vanzator.
4.1. Toate Produsele comercializate de catre Vanzator beneficiaza de conditii de garantie conforme legislatiei in vigoare si politicilor comerciale ale producatorilor.
4.2. Diplon S.R.L. se angajeaza sa ia toate masurile rezonabile pe care le are la dispozitie pentru a pastra confidentialitatea datelor personale puse la dispozitie de Clienti.
5.1 Nici una din parti (Vanzatorul / Clienti) nu va fi raspunzatoare pentru neexecutarea obligatiilor sale contractuale, daca o astfel de neexecutare la termen si/sau in mod corespunzator, total sau partial este datorata unui eveniment de forta majora. Forta majora este evenimentul imprevizibil, in afara controlului partilor si care nu poate fi evitat.
5.2. Daca in termen de 15 (cincisprezece) zile de la data producerii lui, respectivul eveniment nu inceteaza fiecare parte va avea dreptul sa notifice celeilalte parti incetarea de plin drept a contractului fara ca vreuna dintre ele sa poata pretinde celeilalte alte daune-interese.
6.1 Vanzatorul nu este responsabil pentru situatiile in care Site-ul nu functioneaza sau functioneaza necorespunzator ori partial, ori pentru situatiile in care contul / cardul a fost pierdut, furat sau nu functioneaza temporar.
7.1. Vanzatorul poate modifica in orice moment acesti Termenii si Conditii de utilizare website. Versiunea in vigoare a acestora va fi disponibila permanent, pe site-ul www.diplon.ro
7.2. In cazul in care Clientul nu se opune, in scris, aplicarii noilor Termeni si Conditii de utilizare website in termen de 2 saptamani de la publicarea versiunii modificate pe site-ul www.diplon.ro, se va considera ca modificarile aduse Termenilor si Conditiilor de utilizare website sunt acceptate si sunt aplicabile Clientului de la data afisarii pe Site.
